My personal impression is that we should take the line that in this case, and in similar cares, the Colonial Government's consent must be given; that the transfer should be done by mamo, in which as suggested by Sir F.Lugard War Office shall join. The memo should specify that E.0.claim the right to resume land from Admiralty if they wish; subject to Government's consent. We should point out to W.0. what was said to Admiralty in the letter of 10 October 1903 on 30986/03 viz. that the Goverment will not unreasonably withhold consent to retring- fer and ab if they do, there the appeal to the

Secretary of State.

(The fificity from W.C. point of view is I suppose that if transfer wore accomplished, and if the Government after- wards refused consent to a retransfer, W.0. would have lor a bit of hand for nothing and Admiralty would have got it for nothing. But I should have thought 1.0. might fairly be as led to trust the honesty of the Government
